1. Introduction
Welcome to Sweet Highland Bakes. These Terms & Conditions govern your use of our website and the services we provide. Sweet Highland Bakes is a home-based food business operated by Laura, ABN 86 672 048 690, located in Robertson, NSW, Australia. By placing an order with us, you agree to be bound by these Terms & Conditions.
2. Orders & Payments
All orders are placed via our online order form on the website. A 50% deposit is required to confirm your order and secure your date. The balance of 50% is due at the point of collection or delivery. You will receive a secure Square payment link for your deposit. We reserve the right to decline any order at our sole discretion.
3. Pricing
All prices are displayed in Australian dollars (AUD) and are as listed on our website. We may change our prices at any time without notice. GST is not applicable as Sweet Highland Bakes is under the GST registration threshold.
4. Delivery & Collection
Orders may be collected from our premises in Robertson, NSW, or delivered to your address. Delivery is free within the Southern Highlands. A delivery fee applies for orders outside the area and will be quoted prior to order confirmation. You are responsible for providing correct delivery details. Products are perishable and must be stored correctly once received to maintain quality and food safety.
5. Cancellations & Refunds
All products are made to order using fresh, perishable ingredients that are sourced specifically for your order. For this reason, all deposits are non-refundable once your order has been confirmed.
Cancellations made 7 or more days before your event date: Your deposit will be held as credit towards a future order, valid for 3 months from the original event date. No cash refund will be issued.
Cancellations made less than 7 days before your event date: The full deposit is forfeited as ingredients will have already been purchased and preparation may have commenced. Any outstanding balance will not be charged.
Cancellations made within 48 hours of your event: The full order amount (deposit and any balance paid) is forfeited, as your order will have been prepared or will be in the process of being completed.
If Sweet Highland Bakes is unable to fulfil your order: You will receive a full refund of all payments made, including your deposit.
Date changes: Where possible, we will accommodate date changes at no additional cost, provided you give us at least 7 days notice. Date changes within 7 days of the event are subject to availability and may not be possible.
Nothing in this policy excludes or limits your rights under the Australian Consumer Law. If our products fail to meet a consumer guarantee (for example, they are not of acceptable quality or do not match their description), you are entitled to a remedy regardless of this cancellation policy.
6. Allergen & Dietary Disclaimer
This is critical information for your safety. All products are made in a home kitchen that regularly handles common allergens including:
- Wheat and gluten
- Dairy and milk
- Eggs
- Tree nuts (almonds, cashews, macadamias, walnuts)
- Peanuts
- Soy
Cross-contamination cannot be guaranteed. You MUST advise us of all allergies and dietary requirements at the time of ordering. Sweet Highland Bakes takes reasonable care to prevent cross-contamination, but we cannot guarantee allergen-free products. You assume full responsibility for communicating your dietary requirements and assessing the suitability of our products for your needs.
7. Food Safety
All products are handmade and perishable. They should be consumed within the timeframe recommended at delivery. Products must be refrigerated immediately upon receipt. Sweet Highland Bakes is not liable for illness or damage resulting from improper handling or storage of products after delivery or collection.
8. Intellectual Property
All content on this website, including text, images, designs, logos, and product photography, are the intellectual property of Sweet Highland Bakes. You may not reproduce, distribute, or modify any content without our express written permission.
9. Limitation of Liability
To the maximum extent permitted by law, our liability to you is limited to the total value of your order. Nothing in these terms excludes your rights under the Australian Consumer Law.
10. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of NSW.
